Editor's Notes: Authority and Power
Not every attempt to bulldoze the system has the same odds of success or failure.
Today, the Department of Justice proposed a regulation purporting to grant the Attorney General the power to “suspend state bar ethics investigations into current and former DOJ lawyers.” Given that state bar ethics investigations are state investigations, what exactly will be accomplished if this new rule is added to the Federal Register?
Whenever there is news of this kind, such as when Trump signs some new Executive Order claiming dominion over the Earth and the Heavens or whatever it may be, people are understandably worried. “I did not think that presidents could claim dominion over all of known creation,” they might say, “but Trump does a lot of things that I didn’t think presidents could do. Perhaps he’ll do this too.”
